The history of Waqaf in Indonesia is the most baby compared to the countries that we have mentioned before. The Waqaf Act in Indonesia was only implemented in 2004. The Waqaf Act addresses various issues related to Waqaf including the different types of Waqaf, the duration of Waqaf and the descriptions of Nazhir, Waqif and others.
One of the aims of the Waqaf Act is to create the opportunity for a Waqif who wants to donate assets into a Waqaf. Thus, the different types of Waqaf mentioned in the Waqaf Act can be in any form as long as the corpus remains intact. The common type of Waqaf is a piece of land. Cash Waqaf is also accepted to pave the way for people who do not have land but have cash to donate as a Waqaf.
For a Waqif who wants to donate a piece of land into a Waqaf he must ensure that it is perpetual. However, if the Waqif wish to donate in the form of money, a duration is applied. According to the Waqaf Act a cash Waqaf can be either perpetually or temporarily.
While pertaining the Nazhir, the normal term for the administrator of a Waqaf, a Nazhir can be in the form of an individual or an institution. Due to the possibility of complexity issues arising once a Waqaf is developed, the Nazhir in a form of an institution is encouraged. An institution is preferred because it has divisions that take care of various issues, such as legal, finance, and marketing, and can be established to cater to the specific aspects of Waqaf issues.
According to the Waqaf Act, the Badan Waqaf Indonesia (BWI) is a Waqaf regulator and may simultaneously receive a Waqaf, as a Nazhir, from the public. A Nazhir may be also a private institution provided that is licensed from BWI.
BWI has branches in Indonesian provinces. Within the provinces, BWI has offices in almost every city. Therefore, each BWI in the cities is expected to develop Waqaf assets surrounding its areas because they know the empirical situation better than a BWI in a province or even headquarters.
According to the 2020 data obtained from BWI, much of Indonesia's Waqaf land has been used for the building of mosques, graveyards and schools. While the cash Waqaf has potentially reached Rp 188 trillion or USD 12.5 billion.
Though Indonesia's Waqaf Act can be said still at its baby steps, nevertheless it managed to develop a systematic system for its people to perform Waqaf through a trustable and safest mean. But more effort has to be put in creating an effective way to rise the awareness in the community of the importance of Waqaf in Indonesia.
